Overview

A provisional specification secures your priority date for twelve months while you continue developing. The complete specification, with claims, must follow within that year. Claim drafting is the part that decides how much your patent is actually worth, and it is done by a registered patent agent.

DPIIT-recognised startups get an 80 per cent rebate on government fees and access to expedited examination, which can cut years off the grant timeline.

Questions about patent filing

01Can I patent software?

Computer programs per se are excluded under section 3(k). Software with a demonstrable technical effect on hardware can be patentable, but the drafting matters enormously. We give you a candid assessment first.
