Overview

Most trademark applications receive an examination report. An objection is not a refusal — it is the registry asking you to justify the mark. Section 9 objections say the mark is descriptive or non-distinctive; section 11 objections say it conflicts with an existing mark.

The reply must be filed within 30 days or the application is treated as abandoned. A good reply cites case law, distinguishes the cited marks and, where useful, files evidence of use.

Questions about trademark objection reply

01What are my chances?

It depends on the ground. Section 11 objections citing a near-identical mark in the same class are hard to overcome. We give you an honest read before taking the work.
