Overview
A trademark is the only thing standing between your brand and a competitor using the same name. Registration gives you exclusive rights across India in your class, the right to use the ® symbol, and a straightforward path to having infringing listings taken down on Amazon, Flipkart and Instagram.
You can use the ™ symbol the day the application is filed, which is why most founders file early. The registry then examines, advertises in the journal, and — if nobody opposes — registers the mark. The queue is long, but your rights date back to the filing date, not the registration date.

How the filing runs

Search
We search the registry for conflicting marks and tell you honestly if yours is weak. Descriptive names are the most common cause of refusal.

Filed
TM-A filed. You can start using ™ immediately.

Examination
The registry issues an examination report. We draft and file the reply.
- Month 10–16
Journal
Published for opposition. Four months for third parties to object.

Registered

Questions about trademark registration
01Can I trademark a descriptive name?
Rarely. Marks that simply describe the goods — Fresh Milk for dairy — are refused under section 9. Invented or arbitrary names register far more easily, and we will tell you before you spend money.
02How many classes do I need?
One per category of goods or services. A clothing brand that also sells accessories may need two. Each class carries its own government fee.
03What if someone opposes my mark?
You file a counter-statement within two months and the matter goes to a hearing. We quote opposition work separately because it varies widely in effort.
